Terms & Conditions- Photography

 

In the following terms & conditions “the photographer” shall mean (ALLENTAY).

“The client(s)” shall be those persons defined as bride and groom/celebrant/sponsor/event host/promoter on the booking form.

These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed to by the photographer in writing.

 

Law

These Terms and Conditions shall be governed and construed in accordance with the country in which the event is taking place.

Copyright & Ownership

Allentay retains the copyright to all photos and images produced. The Client may receive a copy of the hi-res digital photography/videography on a USB drive/online gallery download if it has been agreed upon as part of the Event Package. If so, the Client may reproduce any photos in any manner they like for internal and external purposes. The Client agrees to obtain written permission from the allentay prior to the Client (or its assigned agents) publishing or selling the Contractor(s) for profit.

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files, or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988 or any related law or that which has been amended. All photographs either digital or printed are watermarked and copyrighted and remain the intellectual property of Allentay.

The client is hereby given usage rights only. No Image/Photo is allowed copied photographically/electronically or by any other means is allowed to be used for commercial purposes without the permission of The Photographer/s in writing.

Removal of Watermarks on Digital or Printed photos can only be done by Allentay, This will be free of charge for up to 5 photos/Client ONLY.  A fee will apply for further photos/Images subject to allentay discretion.

 

Website Display & Promotional Usage/Model Release

The client(s) hereby allow(s) the allentay to display, reproduce, publish, and exhibit, any photograph/Video covered by this contract to generally promote the business in advertising or for instructional or marketing purposes i.e brochures, magazines, articles, websites, social media, sample albums, etc. without payment or any additional fee.

If the Client is unwilling to allow photos to be used to promote business, a premium fee may be charged on request, otherwise, the status quo in the paragraph above is binding.

 

Allentay will aim to keep these photographs safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than allentay employees.

The Client hereby releases allentay and his legal representatives and assigns from all claims and liability relating to said photographs/videos.

 

Force Majeure or Act of God-Allentay

The photographer will endeavor to put the client(s) in touch with another photographer in the event they are unable to attend on the event date due to any cause beyond their reasonable control e.g. sudden illness, injury, a victim of crime, flooding, etc. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid, in the event that allentay is unable to fulfill its contractual obligations and also not able to provide a replacement.

Force Majeure or Act of God-Client

There would be no refund due to Force Majeure (Unforeseen circumstances i.e. sudden illness, injury, a victim of crime, Natural disasters, Pandemic/Epidemic, Strikes, Government Lockdowns, etc, However, allentay will accommodate any postponement or re-scheduling of the event if the date is available on the booking calendar due to Force Majeure (Unforeseen circumstances).  

 

The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

 

Liability

The Photographer shall not be liable for indirect loss or third-party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, the photographer's liability (if any) shall be limited to rectifying such defect.

 

Personal Accident Any directions issued to clients, their guests, or employees during a photographic shoot are deemed to be at said person's own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

 

License

The Photographer shall be granted artistic license in relation to the poses photographed, the location used, and digital retouching. The Photographers’ judgment regarding the locations, poses and number of photographs taken shall be deemed to be correct.

Photographs and Images

All photograph and image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct. All photographs supplied by allentay are produced to the highest standards using the best quality materials and the latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. allentay cannot accept any responsibility for this gradual image deterioration. All pictures purchased are presumed to have been received in good condition unless the Client notifies Allentayphotography in writing of any discrepancy or error within 14 days of receipt.

Location

The Pre or Post Wedding shoot(s) are on location(s) and date(s) agreed by both parties e.g (Outdoors, Park, Beach, Garden, and Funfair, etc) 

Changes to the Location after the contract has been agreed upon and payment of deposit made WOULD incur additional fees as suggested by allentay.

The client MUST  apply for any necessary permit(s) or license(s) that will allow the Photographer(s) to shoot at the client’s location(s) of choice for both the pre and/or post-shoot and Wedding day shoot, The Photographer(s) isn’t responsible for accessibility issues to any location(s). 

The cooperation of Guests and other Service Providers 

Coordination with other service providers may be necessary to complete all the photography/videography as scheduled. 

The client should share the photography/videography schedule with other service providers to make sure that there are no conflicts with times.

In addition, activities during the Event should be planned to make the best use of time for all vendors.

Allentay or any member will not tolerate verbally or physically abusive behavior, nor will the allentay or any member of its Team share its time or compete with guest photographers for the attention of the subjects.

The Client is responsible for the conduct of all its guests, unchecked guest conduct that interferes with photography will seriously affect the quality of the photographs/videos taken and decrease the number of photos that will be created. If the Client is unable to control the conduct of the guests or if the conduct of any of the Event guests damages any of the equipment of the allentay, it will result in the early or immediate departure of allentay.

The Client understands that in such an event, no refund will be given. The Client will also be liable for the cost of repairs/replacement of all damaged equipment.

Exclusivity/Guest Photography & Videography 

If it is pre-agreed that Allentay is the sole professional photographer at the event, it is understood that allentay will be the only one allowed to DIRECT/COORDINATE THE FLOW of photographs/video at the event.

Other Photographers may also take photos during the event if they do not interfere with the workflow of allentay and are not shooting allentay same posed shots.

If a problem arises with any guest or attendee(s), the On-site Event Contact will be advised to handle the situation politely, enforcing the conditions of this agreement.

Non-Guarantees

Although every possible care will be taken to produce photographs/videos of all important and special moments during the Event, allentay cannot place an unconditional guarantee on the above. Allentay will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs/videos.

 

Booking Fee

A booking fee is charged when the client agrees to this contract and is payable on receipt of the invoice, this fee is deducted (in full) from the total price. The booking fee secures the time and services of the photographer/videographer/drone/pilot for the event and is NON-REFUNDABLE OR TRANSFERABLE

Payment

The remaining balance (minus the booking fee) is due in cleared funds 2 WEEKS before the date of the event day/event.

 

Cancellation

Cancellation or Change of Mind less than 28 days prior to the date of the event or as stated on the contract or invoice will result in the payment in full for the complete photographic/service coverage booked.  Allentay will accommodate any postponement or rescheduling of the event if the date is available on the booking calendar.

All cancellations must be in writing. When an Event has been postponed (rather than canceled) to a later date the photographer will retain the fee as long as Allentay can re-schedule for the new date and time. Where Allentay is able to re-book the date with an equivalent booking then the cancellation fee will be reduced to the original booking fee.

 

Please note that a RE-SCHEDULING FEE will apply if the client cancels less than 4 weeks before the event. The amount of fee charged is at the discretion of Allentay

Refund Policy

The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.

 

Retouching

Retouching and artist finishing is available as an optional extra and the final output and finish of any image that is re-touched will be at the photographer’s discretion. Storage of Images Original digital images is kept on an active file for three months, after which time the raw images are stored in a secure location (access to these images is solely limited to the photographer). Raw image files will not be deleted unless expressly requested to do so by the client.

Pricing & Fees

Prices All services and/or goods are supplied at the current prices ruling at the time of each individual payment and are subject to change without prior notice. Allentay is not VAT registered so VAT is not quoted (nor is it charged).

 

Complaints

Any complaints should first be raised by the client with the photographer in writing/email within 21 days from the date of receipt of images.

 

The Photographer reserves the right to amend these Terms and Conditions without prior notice.

 

 

Terms & Conditions- Master of Ceremony

 

In the following terms & conditions “the Master of Ceremony” shall mean Oluwaseyi Allen-Taylor (ALLENTAY).

“The client(s)” shall be those persons defined as celebrant/sponsor/event host/promoteron the booking form.

These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the Master of Ceremony in writing.

 

Website Display & Promotional Usage

The client(s) hereby allow(s) the Master of Ceremony to display any photograph/video or slideshow of himself taken during the event and covered by this contract to generally promote the business in advertising, brochures, magazine, articles, websites, social media, sample albums etc. If the Client is unwilling to allow photos to be used to promote business, a premium fee may be charged on request, otherwise the status quo in the paragraph above is binding.

 

Force Majeure or Act of God- Allentay

The Master of Ceremony will endeavour to put the client(s) in touch with another Master of Ceremony in the event they are unable to attend on the Event date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by the Master of Ceremony, liability shall be limited to a full refund of any fees paid in the event that allentay is unable to fulfil its contractual obligations and also not able to provide a replacement.

A booking fee is charged when the client agrees this contract and payable on receipt of invoice, this fee is deducted (in full) from the total price. The booking fee secures the time and services of the Master of Ceremony for the event and is NON-REFUNDABLE OR TRANSFERABLE.

Payment

Refund Policy

All payments including Fees i.e Deposits are non-refundable.
